These Terms & Conditions ("Terms") govern your use of ChatFlow AI ("the Service", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you confirm you are authorised to bind that company.
1. The Service
ChatFlow AI is a software platform that helps businesses manage WhatsApp conversations, including a shared inbox, AI-assisted replies, chatbots, a knowledge base, contact and lead management, appointments, quotations, and broadcast campaigns. The Service connects to your WhatsApp Business account through Meta's WhatsApp Cloud API and, where enabled, to third-party AI providers and payment services.
2. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity that occurs under your account, including activity by team members you invite. Notify us immediately of any unauthorised use.
3. Acceptable use
You agree to use the Service lawfully and in line with the policies of the platforms it connects to. In particular, you must:
— comply with Meta's WhatsApp Business Messaging, Business, and Commerce policies at all times;
— obtain valid opt-in consent from your contacts before messaging them, and honour opt-out requests;
— not send spam, unlawful, deceptive, harassing, or harmful content, and not upload data you have no right to use;
— not attempt to breach, probe, or overload the Service, or use it to build a competing product.
We may suspend or terminate accounts that violate this section. You understand that Meta may independently restrict or ban WhatsApp numbers that breach its policies, which is outside our control.
4. Subscriptions, billing, and cancellation
Paid plans are billed in advance on a monthly or yearly cycle through Razorpay. Each plan includes usage limits (such as the number of WhatsApp numbers, team members, and contacts) which are enforced by the Service; exceeding a limit requires an upgrade.
You may cancel at any time from the Subscription page. Cancellation stops future renewals; you keep access to paid features until the end of the period already paid for. Except where required by law, fees already paid are non-refundable.
We may change plan pricing or features with reasonable prior notice; changes apply from your next billing cycle.
5. AI-generated content
AI replies are generated by third-party language models and may be inaccurate, incomplete, or unsuitable for your context. You are responsible for reviewing automated replies, configuring your knowledge base appropriately, and for all messages sent from your account — whether written by a person, a chatbot, or AI.
6. Third-party services
The Service depends on third parties — including Meta (WhatsApp), AI providers (OpenAI, Google, Anthropic), Razorpay, and Google — whose availability, pricing, and terms we do not control. ChatFlow AI is an independent product and is not affiliated with, endorsed by, or sponsored by Meta/WhatsApp. Interruptions or changes in third-party services may affect features of the Service, and we are not liable for such third-party failures.
7. Your data and our IP
You retain all rights to the data you and your customers submit to the Service ("Customer Data"). You grant us a limited licence to host and process Customer Data solely to provide and improve the Service. We may use anonymised, aggregated statistics that do not identify you or your customers.
The Service itself — its software, design, and branding — is our intellectual property. These Terms grant you a limited, non-exclusive, non-transferable right to use it while your subscription is active.
8. Termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required by law. On termination, your right to use the Service ends and workspace data is deleted in line with our Privacy Policy.
9. Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, loss of profits, or loss of data. Our total aggregate liability for any claim relating to the Service is limited to the subscription fees you paid to us in the three (3) months preceding the event giving rise to the claim.
10. Indemnity
You agree to indemnify us against claims arising from your Customer Data, your use of the Service in breach of these Terms, or your violation of applicable law or third-party rights (including messaging contacts without consent).
11. Governing law
These Terms are governed by the laws of India, and the courts at the company's registered place of business shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date reflects the latest version; material changes will be notified through the Service, and continued use after changes take effect constitutes acceptance.
